Illinois Choose Life, a not-for-profit adoption advocacy group, has filed a lawsuit in federal court against the state of Illinois for refusing to sell "Choose Life" license plates, the Chicago Tribune reports. The lawsuit alleges that Illinois Secretary of State Jesse White has violated the group's constitutional rights to free speech and due process by refusing to allow the plates, according to the Times (Chicago Tribune, 6/29). The suit requests a court order preventing White from allowing any new specialty license plates or renewing any older specialty plates under the current approval process. ICL spokesperson Dan Proft said, "It is a totally subjective process that amounts to government censorship," according to the AP/San Jose Mercury News. Proft also said that ICL has "no position on abortion," the AP/Mercury News reports. He added, "Pro-life groups are not being funded by these plates. It's strictly about supporting adoption." Dave Druker, a spokesperson for White, said that the lawsuit is "misdirected," adding that the state General Assembly -- not White -- decides how plates are issued, according to the AP/Mercury News. "It's beyond our control," Druker said. Legislation that would have authorized the creation of Choose Life plates was introduced in the General Assembly in 2003, but it failed to gain approval, the AP/Mercury News reports (AP/San Jose Mercury News, 6/29).
